Family mediation is a way of discussing and resolving disputes between a married couple or separating couples. A trained, impartial mediator aids discussions between the parties in order to reach a solution which suits their family’s needs and circumstances. It is usually more cost effective and quicker than going to Court and it can be done face to face or online. The discussions are confidential (save for disclosure of financial information) and the mediator can suggest that they meet with your children if you wish.
The aim of the process is to find a solution which puts the interests of the children first but it also provides an opportunity for the parties to decide how they will manage their finances, any property and other issues such as childcare arrangements. If an agreement is reached it will be reduced to writing and signed. If the Judge approves it then it becomes a legally binding court order. The agreement can be amended by mutual consent if circumstances change but if the parents fail to reach an agreed resolution they may need to return to the Court to ask for intervention.
It is often the case that a mediated solution provides a fresh start for the parties and enables them to close a difficult chapter in their lives with dignity, respect and a clear sense of purpose.
